1.1 Acceptance of Terms: By accessing, purchasing, enrolling in, or otherwise using any website, program, or service operated by Body Physics LTD (“Company”), you (“Client”) acknowledge and agree to be bound by these Terms of Service (“Agreement”). If you do not agree, you must not access or use the Services.
1.2 Scope of Services: The Company provides in-person personal-training sessions, group fitness instruction, online coaching, nutrition guidance, and digital educational materials (collectively, the “Services”) delivered through proprietary websites and the Thrive Coach platform or other third-party systems.
1.3 Eligibility Participation is limited to individuals eighteen (18) years of age or older, or minors with verifiable parental or guardian consent. Clients represent that they are physically and medically capable of safely engaging in the Services.
1.4 Client Obligations: Clients shall: (a) follow all instructions and safety guidelines issued by the Company; (b) obtain medical clearance from a licensed physician prior to commencing any program; and (c) maintain confidentiality of login credentials and other account information. Clients are responsible for all activity conducted under their credentials.
1.5 Scheduling and Cancellations: Cancellations or rescheduling must be communicated in accordance with the following notice requirements: (a) at least twenty-four (24) hours for weekday appointments; (b) forty-eight (48) hours for weekend appointments; and (c) seventy-two (72) hours for holiday appointments. Failure to provide timely notice constitutes a late cancellation and subjects the Client to a charge equal to one-hundred percent (100%) of the session fee. All fees for scheduled appointments are charged at the time of scheduling.
1.6 Payments: In person appointments are payable by check, Venmo or stripe. All other fees are payable by through Stripe or other authorized processor. Client agrees to provide accurate billing information and authorizes the Company to process charges for all purchased Services.
1.7 Intellectual Property: All content, materials, programs, and media provided by the Company are the exclusive property of Body Physics LTD and are protected by applicable intellectual-property laws. Client receives a limited, non-transferable, non-exclusive license for personal use only and shall not reproduce, distribute, or publicly display such materials without prior written consent.
1.8 Assumption of Risk and Release of Liability: Client acknowledges that physical exercise and dietary modification involve inherent risks of injury, illness, and property damage. Client voluntarily assumes all such risks and, to the maximum extent permitted by law, releases and holds harmless Body Physics LTD, its owners, employees, contractors, and affiliates from any and all claims, demands, causes of action, or liabilities arising out of participation in the Services, whether occurring onsite, online, or elsewhere, including claims resulting from the negligence of the Company.
1.9 Modification of Agreement: The Company may amend this Agreement at any time by posting an updated version on its website. Continued use of the Services constitutes acceptance of the revised terms.
2. PRIVACY POLICY
2.1 Overview: Body Physics LTD (“we,” “us,” “our”) respects the privacy of its clients and visitors and is committed to safeguarding personal information in compliance with applicable data-protection legislation. Body Physics LTD will never sell your personal data.
2.2 Information Collected: We may collect and process the following categories of information:(a) identifiers such as name, email address, telephone number;(b) fitness-related and biometric information including measurements, photographs, and progress data;(c) payment information processed through Stripe or other third-party payment gateways; and(d) technical information automatically collected via cookies, analytics tools, or tracking pixels.
2.3 Purpose of Processing: Data is processed for the following legitimate business purposes: (a) to provide, administer, and personalize Services; (b) to communicate with Clients; (c) to improve our offerings; and (d) to comply with legal obligations or enforce rights.
2.4 Data Retention and Security: Personal data is stored within the Thrive Coach platform or other secure systems using reasonable technical and organizational safeguards. Access is restricted to authorized personnel who require the information for business purposes.
2.5 Cookies and Analytics: Our website or associated service providers may utilize cookies and tracking technologies, including but not limited to Google Analytics and Facebook Pixel. By using our website, you consent to such processing. You may disable cookies through your browser settings.
2.6 Data Subject Rights: Clients may request access to, correction of, or deletion of their personal data by contacting Cyndi@sgtcyndi.com. Requests will be honored within a reasonable period consistent with applicable law.
2.7 Third-Party Links: The website may contain links to external sites. We are not responsible for the content or privacy practices of any third-party website.
3. REFUND AND CANCELLATION POLICY
3.1 Refunds Except as expressly provided herein, all sales are final and non-refundable. Refunds are not available for in-person or online training services. For designated online programs, if a Client has fully completed all required components, including submission of progress photographs, measurements, and documentation of compliance, and demonstrates no measurable improvement, the Company may, at its sole discretion, issue a refund. Such determination shall be final.
3.2 Cancellations of Appointments: Notice requirements are as stated in Section 1.5. Failure to comply results in the Client being charged the full session fee. No credit or rescheduling will be provided for missed sessions without appropriate notice.
3.3 Future Subscriptions: Should the Company introduce subscription or membership services in the future, separate written terms will specify auto-renewal and cancellation rights in accordance with applicable consumer-protection statutes.
4. HEALTH AND MEDICAL DISCLAIMER: All materials and information supplied by Body Physics LTD are provided for general educational purposes only and do not constitute medical advice, diagnosis, or treatment. No statements made by the Company have been evaluated by any governmental or medical authority. Clients are strongly advised to consult a licensed physician or other qualified health-care provider before commencing any exercise, nutrition, or lifestyle program. Participation is voluntary and undertaken at the Client’s sole risk. If the Client experiences dizziness, pain, shortness of breath, or other adverse symptoms, the Client shall discontinue the activity immediately and seek medical attention. By engaging in the Services, the Client affirms that they understand and accept full responsibility for their physical and mental well-being.
